WINNIPEG - The Manitoba Court of Appeal has ruled that a man accused of street racing before a fatal crash should be freed from custody, pending his appeal.
Scott Trembley, 24, was given a two-year sentence after a jury convicted him last fall of dangerous driving causing death. The high court has ruled that Trembley should get bail while his lawyer appeals the sentence.
Linda Rudnicki, 39, died in June 2005 after her car was slammed by another vehicle in west Winnipeg.
The trial judge rejected a defence lawyer's plea for house arrest, saying drag racing on busy streets must be loudly denounced.
Trembley was acquitted of the more serious charge of criminal negligence causing death.
