EDMONTON - Alberta's justice minister is reviewing a provincial court decision to strike down a 2003 traffic ticket issued to a francophone trucker because it was written only in English.
Judge Leo Wenden ruled this week that Alberta's Languages Act and Traffic Safety Act do not apply to Gilles Caron because they are not written in French.
Although the judge says this ruling only applies to Caron, Justice Minister Alison Redford is said to be taking the decision very seriously with regards to a possible appeal.
The judge has granted a three-month stay to allow the Crown time to review the case and consider taking it to the next level.
Caron and his lawyer have said in the past that they are prepared to take this case all the way to the Supreme Court of Canada.
But Justice Department spokesman David Dear says the Supreme Court has previously upheld Alberta's laws, even though they are written only in English.
